Due to the impact of COVID 19 pandemic, businesses are faced with maintaining cash flow, jobs, and salary paying. The first priority is retaining jobs and incomes for each employee, but there are plenty of solutions in order to downsize the labor and salary costs that the CEO is forced to consider, such as job stoppage, suspension labor contract, contract termination labor contract ...

Suspension pay shall be considered based on the causes of work suspension (at the employer's or employee's fault or for an objective reason). If it's employee's fault, he/she is not entitled to payment of wage. If the fault is from the employer, the employee is entitled to payment of the full wage;
Due to the COVID 19 pandemic, the wage for work suspension must be agreed by two parties but must not be lower than the regional minimum wage stipulated by the Government.
Due to the affection of COVID 19 pandemic, production needs are not provided enough for employee to work. Employers may temporarily assign an employee to perform a job which is not stated in the labor contract. However, the assignment does not exceed 60 accumulated workdays within one year, unless otherwise agreed by the employee. The employer shall inform the employee at least 3 working days in advance. If the wage for the new job is lower than the previous wage, he/she is entitled to the previous wage for 30 working days. The wage for the new job must be at least 85% of the previous wage but not lower than the regional minimum wage stipulated by the Government.
Enterprises may suspend a labor contract temporarily with employee as agreed upon by the two parties. The temporary suspension of the labor contract shall be made in an agreement which must contain period of suspension: the start time and the end time of the suspension period; Within 15 days after the date of expiration of the employment contract suspension, the employee must be present at the workplace and the employer must reinstate the employee.
As a result of this pandemic, the enterprises, though having applied every remedial measure, has to scale down production and cut jobs. The employers have a right to unilaterally terminate labor contracts. Nevertheless, this termination must be informed to employees by employers in advance.

DIRECTIVE NATIONWIDE QUARANTINE

Specified in the Prime Minister's Directive No. 16/CT-TTg 19

The Prime Minister's Directive no. 16/CT-TTg dated March 31, 2020 implement the following urgent measures on Covid 19:

Carry out nationwide quarantine for 15 days from 12 am of April 01, 2020 between families, neighborhoods/villages, communes, districts, provinces. Workers in factories shall keep a safety distance, wear facemasks, and sanitize the workplace as prescribed.
The people are advised to stay at home and only go outside when strictly necessary such as buying food or medicines, providing emergency treatment, going to work at facilities that are allowed to maintain operation to provides essential goods or services, and in other urgent circumstances; maintain a safety distance of 2 m during communication. Do not form groups of more than 2 people outside office buildings, schools, hospitals and in public places.

This Directive just to enhance The Ministry of Transport, the People's Committees of provinces to order shutdown of public transportation; restrict movement from one area to another; stop movement from affected areas to other areas except for performance of official tasks, provision of food and essential consumables, transport of workers and specialists of enterprises, transport of raw materials for production.
This Directive is not effective as an order to suspend all business activeities in office building or factories.

Temporary Residence Card In Vietnam

What you need to know

Temporary residence card is a necessary document for expats who want to reside for a definite period of time in Vietnam. However, depending on each case the temporary residence card can be issued for a different period of time and also required different documents.

What is a temporary residence card (TRC)?

Expats who want to stay and work in Vietnam need to obtain a temporary residence card. Temporary residence card (TRC) can be considered as a long-term visa.
Unlike Visa, the temporary residence card has longer validity, it normally stays valid for 01 year to 05 years. Temporary residence cardholders will be exempted from visa and can save a large amount of time and money for visa application and extension for Vietnam entry, exit, and residence.

Temporary residence card is granted for:

A foreigner who is a member of the two members limited liability company or more;
A foreigner who is the owner of the one member limited liability company (except as authorized representatives);

The validity of the temporary residence card:

The duration of TRC is at least 01 month shorter than the duration of the passport.
Temporary residence cards with the code NG3, LV1, LV2, ĐT, and DH have a term of no more than 05 years.

01 duly copy of Business License (the remain effective date at least 06 months)

Original of Passport and business visa (Valid Visa should be sponsored by current company client working for) – Passport longer minimum period equal to the duration is expected to apply for TRC
